Terms of Service

1. Acceptance and eligibility

By creating an account or using our marketplace, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these terms. If you are using Aisle 233 on behalf of a business, you represent that you have authority to bind that business. We reserve the right to refuse service or terminate accounts that violate these terms or applicable law.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when registering and keep it up to date. You must notify us promptly of any unauthorized use of your account. We are not liable for losses resulting from someone else using your account due to your failure to safeguard your login details.

3. Using the marketplace (customers)

As a customer, you may browse products, add items from multiple vendors to a single cart, place orders, and use our consolidated delivery or pickup options. You agree to provide accurate delivery and payment information and to pay for orders in full. Prices and availability are set by vendors; we facilitate the transaction and delivery but are not the vendor of third-party products. Refunds and returns are handled in accordance with our refund policy and, where applicable, individual vendor policies.

4. Using the marketplace (vendors)

If you register as a vendor, you may list products, join stalls or promotions, and sell through Aisle 233 subject to any applicable vendor agreements and policies. You are responsible for the accuracy of your listings, the quality and legality of your products, and timely fulfillment of orders. You must comply with all applicable laws, including consumer protection and tax obligations. We may suspend or terminate vendor accounts for breach of these terms or for conduct that we reasonably believe harms the platform or other users.

5. Orders, payments, and delivery

When you place an order, you enter into a contract with the relevant vendor(s); Aisle 233 acts as an intermediary. We or our payment partners process payments on behalf of vendors. Delivery times and methods are as described at checkout; we do not guarantee specific delivery dates. Risk of loss typically passes to you upon delivery or pickup. Disputes about product quality or non-delivery should be reported through our support or dispute process; we may assist in resolution but are not liable for vendor conduct beyond our role as facilitator.

6. Prohibited conduct

You may not use Aisle 233 to:

• Violate any applicable law or regulation.
• Infringe the intellectual property or other rights of others.
• List or sell illegal, counterfeit, or prohibited items.
• Misrepresent your identity, products, or business.
• Harass, abuse, or harm other users or our staff.
• Attempt to gain unauthorized access to our systems or other accounts.
• Use automated means (e.g. scrapers or bots) without our permission.
• Interfere with the proper operation of the platform.

We may remove content, cancel orders, or suspend or terminate accounts that violate these rules.

7. Intellectual property

Aisle 233 and its logos, design, and content (excluding user-generated content) are owned by us or our licensors. You may not copy, modify, or use our branding or platform content for commercial purposes without our written permission. You retain ownership of content you submit (e.g. product listings, reviews); you grant us a licence to use, display, and distribute that content in connection with operating the marketplace.

8. Disclaimers

The platform and services are provided "as is" and "as available". We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties to the fullest extent permitted by law. We are not responsible for the conduct of vendors or other users, or for the quality, safety, or legality of products listed on the marketplace. Any reliance on information on the site is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Aisle 233 and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the platform or inability to use it. Our total liability for any claims arising from these terms or your use of the service shall not exceed the amount you paid to us in the twelve months preceding the claim (or, if you are a vendor, the fees we received from you in that period). Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Aisle 233 and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, your violation of any law or the rights of a third party, or any content you submit.

11. Termination

You may close your account at any time. We may suspend or terminate your account or access to the platform if we reasonably believe you have breached these terms or for operational or legal reasons. Upon termination, your right to use the platform ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will remain in effect.

12. Disputes and governing law

These terms are governed by the laws of Ghana, without regard to conflict of law principles. Any dispute arising from these terms or your use of Aisle 233 shall be subject to the exclusive jurisdiction of the courts of Ghana. We encourage you to contact us first to seek an informal resolution.

13. Changes to these terms

We may update these Terms of Service from time to time. We will post the revised terms on this page and update the "Last updated" date. If changes are material, we may notify you by email or through the platform. Continued use of Aisle 233 after changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the platform and may close your account.
